These Terms & Conditions ("Terms") govern your access to and use of AMOF and related software, services, websites, documentation, and digital products provided by Hotshot Creative s. r. o., with registered office at Kostolná 84/14, 034 91 Švošov, Slovakia, Company ID 56569629, Tax ID 2122346479 ("Hotshot Creative", "we", "us", or "our").

By accessing, purchasing, using, or interacting with AMOF, you agree to these Terms. If you do not agree, do not use the service.

1. About AMOF

AMOF is a software product and control plane designed to support ecosystem orchestration, run execution, agent workflows, observability, release workflows, and related development operations. Depending on the plan, AMOF may include software components, hosted features, documentation, updates, early access functionality, and related support or onboarding services.

2. Eligibility

You may use AMOF only if you are legally capable of entering into binding agreements under applicable law. If you use AMOF on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms. AMOF is intended primarily for professional, technical, and business use, but may also be purchased by individual developers unless stated otherwise.

3. Accounts and Access

Some AMOF features may require account creation, invitation, payment, or manual provisioning. You are responsible for keeping your login credentials secure and for all activity under your account or access credentials. We may restrict, suspend, or revoke access if you violate these Terms, your use creates legal, security, or operational risk, payment fails or is disputed, access was granted in error, or AMOF is being abused, misused, or used beyond the intended scope.

4. Plans, Pricing, and Payments

AMOF may be offered under free, paid, early-access, or enterprise plans. Pricing and feature access are described on the website or in a separate commercial offer. Payments may be processed through Stripe or another authorized payment provider. By purchasing a paid plan, you agree to pay the applicable price, taxes, and any additional charges shown at checkout. Unless stated otherwise: prices may change for future purchases, promotional pricing may be temporary, and enterprise plans may be governed by separate commercial terms.

5. Delivery and Access

AMOF is a digital product/service. Access may be granted immediately, manually, progressively, or after onboarding, depending on the plan and current product stage. We do not guarantee that all features shown on the website are available in every plan, region, or product maturity stage. Early-access features may change, be limited, or be discontinued.

6. Refunds and Cancellations

Because AMOF may be sold as a digital product, software license, or early-access software offering, purchases are generally non-refundable once access, license delivery, onboarding, or product availability has been provided. This is especially important for early-access plans, where the customer receives access to evolving software, product updates, and/or early product availability rather than a finished boxed product. If you believe you were charged incorrectly, contact us at marek@hotshot.sk and we will review the case in good faith. Nothing in these Terms limits any mandatory rights you may have under applicable consumer protection law.

7. License and Permitted Use

Subject to these Terms and any applicable plan limitations, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use AMOF for your internal personal or business purposes. You may not: resell AMOF unless explicitly authorized; sublicense, rent, lease, or redistribute the service; reverse engineer or attempt to extract protected parts of the software beyond rights allowed by law; bypass usage restrictions, licensing controls, or plan limitations; or use AMOF to violate laws, security controls, or third-party rights.

8. Acceptable Use Restrictions

You agree not to: use AMOF for unlawful, fraudulent, abusive, or harmful activities; attempt unauthorized access to systems, accounts, or data; interfere with service availability or security; upload or process content that you do not have the right to use; or use the service to create harmful, malicious, or abusive automation.

9. Intellectual Property

AMOF, including its software, branding, interface, documentation, design, and related materials, is owned by Hotshot Creative s. r. o. or its licensors and protected by applicable intellectual property laws. These Terms do not transfer ownership of AMOF or any intellectual property to you.

10. Feedback

If you provide feedback, suggestions, or ideas about AMOF, you agree that we may use, modify, and incorporate them without restriction or compensation, unless otherwise agreed in writing.

11. Availability and Product Changes

AMOF may evolve rapidly. We may modify, improve, limit, or discontinue parts of the product at any time. We may also change features, workflows, pricing, packaging, or technical requirements. We do not guarantee uninterrupted availability, perfect accuracy, or error-free operation.

12. Third-Party Services

AMOF may integrate with or depend on third-party services, including payment processors, hosting providers, infrastructure tools, model providers, or external APIs. We are not responsible for third-party services outside our reasonable control.

13. Disclaimer

AMOF is provided on an "as is" and "as available" basis to the fullest extent permitted by law. We do not guarantee that the service will always be uninterrupted, that every result or automation will be accurate, that the software will be free of bugs, or that the service will fit every specific business need.

14. Limitation of Liability

To the fullest extent permitted by law, Hotshot Creative s. r. o. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, business opportunity, or goodwill arising out of or related to the use of AMOF. To the extent liability cannot be excluded, our total aggregate liability shall be limited to the amount you paid for AMOF in the 12 months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

15. Suspension and Termination

We may suspend or terminate access if you breach these Terms, payment is not completed or is reversed, your usage poses technical, legal, or security risk, or the product/service is discontinued. You may stop using AMOF at any time. Sections that by their nature should survive termination will survive termination, including intellectual property, disclaimers, limitations of liability, and governing law.

16. Governing Law

These Terms are governed by the laws of the Slovak Republic, unless mandatory consumer protection law requires otherwise.

17. Changes to These Terms

We may update these Terms from time to time. The updated version becomes effective when published on the website or otherwise communicated to users. Continued use of AMOF after changes means you accept the updated Terms.
